Are all of the foregoing purveyors of obscenity?
If Casanova’s Homecoming'’ is obscene, if a
complaint properly lies against Simon and Schus¬
ter, then all of the above should properly be hailed
into court on similar complaints. Any other course
would lead to a kind of discrimination which is in¬
tolerable in law. To hold Simon and Schuster for
trial is to indict the entire community, for the
statute itself makes no distinction between the pub¬
lisher and he who advertises or disseminates the
book in any manner.
The community is in accord with these defend¬
ants and have endorsed Casanova’s Homecoming'?
as a great classic.
